These Terms of Service govern your access to and use of the BareDot website, store, products, content, and related services.

By accessing the website, creating an account, or placing an order, you agree to these Terms of Service and our Privacy Policy and Returns and Refunds Policy.

Do not use the website when you do not agree to these Terms.

1. Eligibility

You must be at least the age of legal majority in your jurisdiction to enter into a binding purchase agreement independently.

People below the age of legal majority may use the website or place an order only with the permission and involvement of a parent or legal guardian.

By placing an order, you represent that the information you submit is accurate and that you are authorized to use the selected payment method.

4. Skincare Disclaimer

BareDot products are intended for external cosmetic or personal-care use unless stated otherwise.

Our products and website content are not intended to:

• Cure acne

• Treat an infection

• Replace professional medical care

• Guarantee a particular skincare result

Individual results vary.

Follow all product instructions and discontinue use if irritation, pain, swelling, or another adverse reaction occurs. Seek appropriate medical advice for severe, persistent, infected, or painful skin conditions.

Do not apply products to the eyes, inside the mouth, severely damaged skin, or any area prohibited by the product instructions.

5. Prices and Payment

Prices are displayed in U.S. dollars unless otherwise stated.

We may change prices, discounts, product availability, and promotions at any time. A price change will not affect an order already accepted, except when correcting an obvious pricing error.

Applicable taxes, shipping costs, and other charges will be displayed during checkout when available.

You agree to provide current and accurate billing, payment, and account information.

We may use third-party payment processors. Your payment information may be subject to the processor’s terms and privacy practices.

6. Orders

Submitting an order is an offer to purchase. An automated confirmation does not guarantee acceptance.

We may accept, reject, limit, or cancel an order for reasons including:

Customers are responsible for providing a complete and accurate delivery address.

When we cannot ship within the time promised or within the period required by applicable law, we will provide any notice, delay option, cancellation opportunity, or refund required by law.

Ownership and risk of loss transfer as provided by applicable law and the relevant carrier arrangement. Nothing in this section limits rights that cannot legally be waived.

8. Returns and Refunds

Returns, replacements, cancellations, and refunds are governed by our Returns and Refunds Policy, which forms part of these Terms.

We may require reasonable evidence when reviewing damaged-item, missing-order, refund, or replacement claims.

9. Promotions and Discount Codes

Promotions may be subject to additional conditions.

Unless stated otherwise:

• Discount codes cannot be combined

• Codes have no cash value

• Codes cannot be applied retroactively

• Promotions may be limited by date, customer, product, or quantity

• Free gifts cannot be exchanged for cash

• Returned orders may lose discounts or promotional eligibility

We may cancel or modify a promotion when there is an error, abuse, fraud, or another legitimate business reason, subject to applicable law.

When you submit a review, photograph, video, comment, or other content, you represent that:

• The content is truthful

• It reflects your genuine experience

• You own it or have permission to submit it

• It does not violate another person’s rights

• It is not unlawful, deceptive, defamatory, threatening, or obscene

• Any incentive or material relationship has been properly disclosed

You retain ownership of your content.

By submitting content for publication, you grant BareDot a nonexclusive, worldwide, royalty-free license to host, reproduce, format, publish, display, and use that content in connection with our website, advertising, social media, and business operations, unless otherwise agreed in writing.

We may moderate or remove content that violates these Terms, but we are not required to publish every submission.

We will not knowingly condition an incentive on a customer providing a positive review.

11. Intellectual Property

The website and its content—including the BareDot name, logo, designs, photographs, graphics, text, product descriptions, videos, and website layout—are owned by or licensed to BareDot and are protected by applicable intellectual-property laws.

No license is granted except the limited right to access and use the website for personal, noncommercial shopping purposes.

You may not copy, reproduce, distribute, modify, sell, or commercially exploit our content without prior permission.

We do not control third-party services and are not responsible for their independent actions, availability, terms, content, or privacy practices.

We do not guarantee that:

• Every defect will be corrected immediately

• Website content will meet every user’s needs

• A product will produce a specific cosmetic result

Products remain subject to any express warranty stated on the product page and to rights and warranties that cannot legally be excluded.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, BareDot and its owners, employees, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or products.

Where liability cannot be excluded, our total liability arising from a purchase will not exceed the amount paid for the product giving rise to the claim, except where a different limitation is required by law.

Nothing in these Terms excludes liability that cannot legally be limited, including liability resulting from fraud, willful misconduct, or another legally non-waivable obligation.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold BareDot harmless from third-party claims, losses, and reasonable expenses resulting from:

• Your unlawful use of the website

• Your violation of these Terms

• Your infringement of another person’s rights

• Content you submit

• Fraudulent conduct associated with your account

This provision does not apply where prohibited by law.

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable federal law, without regard to conflict-of-law rules.

Mandatory consumer-protection rights under the laws of your place of residence remain unaffected where they cannot legally be waived.

Before beginning formal proceedings, you agree to make a good-faith attempt to resolve the dispute by submitting a detailed request through the contact form on our website.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court or seeking urgent relief where appropriate.

We have intentionally not included a mandatory arbitration provision or class-action waiver in this starter version. Such provisions should not be added without individualized legal review.

21. Severability

When any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

22. No Waiver

A failure to enforce a provision does not waive the right to enforce it later.

23. Entire Agreement

These Terms, together with the Privacy Policy, Returns and Refunds Policy, and any additional checkout terms, form the entire agreement regarding use of the website and purchases from BareDot.

24. Changes to These Terms

We may update these Terms to reflect changes in our services, business operations, or legal obligations.

The revised version will be posted with an updated effective date. Changes will not retroactively alter completed purchases unless permitted or required by law.
